Object

The purpose of these General Terms and Conditions is to define the terms and conditions under which the services of the Reflextime website, hereinafter referred to as "the Service", are made available and the conditions of use of the Service by the User.

Any access to and/or use of the Service implies acceptance of and compliance with all the terms of these Conditions and their unconditional acceptance. They therefore constitute a contract between the Service and the User.

If the User does not wish to accept all or part of these terms and conditions, he/she is asked to refrain from using the Service.

Definitions

User: The User is any person who uses the Site or any of the services offered on the Site.
User Content: The term "User Content" refers to the data transmitted by the User in the various sections of the Site.
Member: The term "Member" refers to a user identified on the Site.
Login: The term "Identifier" covers the information required to identify a user on the site in order to access the areas reserved for members.
Password: The "Password" is a confidential piece of information, which the User must keep secret, enabling him/her, used in conjunction with his/her Identifier, to prove his/her identity.

Service access

The Service is accessible free of charge to any User with Internet access. All costs relating to access to the Service, whether hardware, software or Internet access, are the sole responsibility of the User. The User is solely responsible for the proper functioning of his/her computer equipment and Internet access.

Certain sections of the site are reserved for Members, who must identify themselves using their Login and Password.

The Service reserves the right to refuse access to the Service, unilaterally and without prior notice, to any User who does not comply with these terms of use.

The Service uses all reasonable means at its disposal to ensure quality access to the Service, but is under no obligation to do so.

In addition, the Service cannot be held responsible for any network or server malfunction or any other event beyond reasonable control, which prevents or impairs access to the Service.

The Service reserves the right to interrupt, temporarily suspend or modify without notice access to all or part of the Service, in order to carry out maintenance, or for any other reason, without the interruption giving rise to any obligation or compensation.

Intellectual property

The Service, and in particular its content, is protected by French law. The Service is the exclusive owner of all intellectual property rights to the site and its content (texts, photographs, illustrations, images, logos, etc.).

The content reproduced on the Site is subject to copyright and its reproduction or distribution, without the express written authorization of Le Service, constitutes an infringement punishable by law.

ReflexTime and Reflexcare are registered trademarks of the Service. Any unauthorized reproduction of these trademarks, logos and distinctive signs constitutes an infringement punishable by law. The offender is liable to civil and criminal penalties, in particular those provided for in articles L. 335.2 and L. 343.1 of the French Intellectual Property Code.

The User is solely responsible for the User Content he/she places online via the Service, as well as for the texts and/or opinions he/she formulates. The User expressly transfers to the Service, free of charge, all intellectual property rights pertaining thereto, and in particular the right of reproduction, representation and adaptation, for the legal duration of copyright protection. In particular, he/she undertakes to ensure that such data does not infringe the legitimate interests of any third party whatsoever. In this respect, he/she guarantees the Service against all claims, based directly or indirectly on these comments and/or data, which may be brought by anyone against the Service. In particular, he/she undertakes to pay any sums resulting from a third party's action against the Service, including legal fees and court costs.

The Service reserves the right to delete all or part of the User Content, at any time and for any reason whatsoever, without prior warning or justification. The User may not make any claim in this respect.

Personal data & Data processing

In accordance with article 34 of the French Data Protection Act (Loi Informatique et Libertés), the Service guarantees the User the right to oppose, access and rectify any personal data concerning him or her.

The information collected on contact forms is recorded in a file computerized by Scopika for the management of contact requests, services and are limited to the strict necessary in accordance with European regulations (RGPD). No data from the forms is transmitted to third parties.
They are kept for a maximum of one year and are intended for the sales or technical department only.

In accordance with the French Data Protection Act, you may exercise your right to access, rectify or delete your personal data by contacting us via our contact form.

Force majeure

The Service cannot be held liable in the event of force majeure or events beyond its control.

Duration and termination

The present contract is concluded for an indefinite period from the date of use of the Service by the User.

Applicable law and jurisdiction

The legal rules applicable to the content and transmission of data on and around the site are determined by French law. In the event of a dispute which cannot be settled amicably, the French courts within the jurisdiction of the Clermont-Ferrand Court of Appeal shall have sole jurisdiction.
