Purpose

The purpose of these General Terms and Conditions is to define the terms and conditions under which the services of the Reflextime website, hereinafter referred to as "the Service", are made available, as well as the conditions for using the Service by the User.

Any access and/or Use of the Service implies the acceptance of and compliance with all the terms of these Conditions and their unconditional acceptance. They therefore constitute a contract between the Service and the User.

If the User does not wish to accept all or part of these general terms and conditions, they are requested to refrain from any use of the Service.

Definitions

User: The User is any person who uses the Site or one of the services offered on the Site.
User Content: The term "User Content" refers to the data transmitted by the User within the various sections of the Site.
Member: The term "Member" refers to a user identified on the site.
Username: The term "Username" covers the information necessary to identify a user on the site in order to access member-only areas.
Password: The "Password" is confidential information, which the User must keep secret, allowing them, when used in conjunction with their Username, to prove their identity.

Access to the service

The Service is accessible free of charge to any User with Internet access. All costs related to accessing the Service, whether hardware, software, or Internet access fees, are solely the responsibility of the user. The user is solely responsible for the proper functioning of their computer equipment as well as their Internet access.

Certain sections of the site are reserved for Members upon identification using their Username and Password.

The Service reserves the right to deny access to the Service, unilaterally and without prior notice, to any User who does not comply with these terms of use.

The Service implements all reasonable means at its disposal to ensure quality access to the Service, but is under no obligation to achieve this result.

Furthermore, the Service cannot be held liable for any network or server malfunction, or any other event beyond reasonable control, that would prevent or degrade access to the Service.

The Service reserves the right to interrupt, temporarily suspend, or modify without notice access to all or part of the Service, in order to perform maintenance, or for any other reason, without such interruption giving rise to any obligation or compensation.

Intellectual property

The Service, in particular its content, is protected by the laws in force in France. The Service is the exclusive holder of all intellectual property rights relating to the site and its content (texts, photographs, illustrations, images, logos, etc.).

The content reproduced on the Site is subject to copyright, and its reproduction or distribution, without express written authorization from the Service, constitutes an infringement subject to criminal penalties.

ReflexTime and Reflexcare are registered trademarks of the Service. Any unauthorized reproduction of these trademarks, logos, and distinctive signs constitutes an infringement subject to criminal penalties. The infringer is liable to civil and criminal sanctions, including the penalties provided for in Articles L. 335.2 and L. 343.1 of the French Intellectual Property Code.

The User is solely responsible for the User Content they publish online via the Service, as well as the texts and/or opinions they express. The User expressly and freely grants the Service all intellectual property rights pertaining thereto, specifically the right of reproduction, representation, and adaptation, for the legal duration of copyright protection. In particular, the User undertakes to ensure that this data does not harm the legitimate interests of any third party. As such, the User indemnifies the Service against any claims, based directly or indirectly on these remarks and/or data, that may be brought by anyone against the Service. In particular, the User agrees to pay all amounts, of whatever nature, resulting from any third-party claim against the Service, including attorneys' fees and legal costs.

The Service reserves the right to delete all or part of the User Content at any time and for any reason whatsoever, without prior notice or justification. The User may not make any claim in this respect.

Personal Data & Data Processing

In accordance with Article 34 of the French "Data Protection" law, the Service guarantees the User the right to object to, access, and rectify personal data concerning them.

Information collected via contact forms is recorded in a computerized file by Scopika to manage contact and service requests, and is strictly limited to what is necessary in accordance with European regulations (GDPR). No data from the forms is transmitted to third parties.
It is retained for a maximum of one year and is intended solely for the sales or technical departments.

In accordance with the French "Data Protection" law, you may exercise your right to access data concerning you and have it rectified or deleted by contacting us via our contact form.

Cookies, Collected Data

Limitations of liability

Access to certain sections of the Service requires the use of a Username and a Password. The Password, chosen by the user, is personal and confidential. The user undertakes to keep their password secret and not to disclose it in any form whatsoever. The use of their Username and Password over the Internet is at the User's own risk. It is the User's responsibility to take all necessary measures to protect their own data against any infringement.

The Service nevertheless undertakes to implement all necessary measures to ensure the security and confidentiality of transmitted data. The User is informed that one or more cookies, containing no personal information, may be placed on their hard drive to ensure their identification.

The User acknowledges that they are aware of the limitations and constraints inherent to the Internet network and, as such, specifically recognizes the impossibility of an absolute guarantee regarding the security of data exchanges. The Service cannot be held liable for any damages resulting from the transmission of any information, including their username and/or password, via the Service.

The Service may under no circumstances, to the extent permitted by applicable law, be held liable for damages and/or harm, direct or indirect, material or immaterial, or of any nature whatsoever, resulting from the unavailability of the Service or any Use of the Service. The term "Use" must be understood in the broadest sense, i.e., any use of the site whatsoever, whether lawful or not.

The User generally agrees to comply with all regulations in force in France.

Force Majeure

The Service cannot be held liable in the event of force majeure or circumstances beyond its control.

Amendments to this agreement: the Service reserves the right to modify the terms, conditions, and notices of this agreement at any time.

The User is therefore advised to regularly check the latest version of the Terms of Use available on the Service.

Duration and termination

This agreement is entered into for an indefinite period starting from the Use of the Service by the User.

Applicable law and competent jurisdiction

Legal rules applicable to content and data transmissions on and around the site are governed by French law. In the event of a dispute that cannot be resolved amicably, only the French courts within the jurisdiction of the Court of Appeal of Clermont-Ferrand shall have jurisdiction.
